Terms of use

These terms of use (the « Terms ») govern access to and use of the RakoonTV service, published by TENSAI IT (the rakoontv.fr website and the mobile application). By using RakoonTV, you accept these Terms.

1. Purpose of the service

RakoonTV is a series and movie tracking service: it lets you organise your lists, follow your progress, know upcoming releases, rate and comment on works, and interact with your friends. Metadata of works is provided by TheTVDB.

2. Acceptance of the Terms

Use of the service implies full and unreserved acceptance of these Terms. If you do not accept these terms, you must not use RakoonTV.

3. Access to the service

RakoonTV is offered free of charge. Some features require the creation of an account. Access to the service requires a compatible device and an Internet connection, the costs of which remain your responsibility. The service is under development: features may change, appear or be removed.

4. User account

  • You undertake to provide accurate information when creating your account;
  • You are responsible for the confidentiality of your credentials and for any activity carried out from your account;
  • You must inform us without delay of any unauthorised use of your account.

5. Rules of use

When using RakoonTV, you undertake not to:

  • publish unlawful, hateful, defamatory or harassing content, or content infringing the rights of others;
  • disclose spoilers without using the marking provided for that purpose;
  • disrupt the operation of the service (spam, intrusion attempts, circumvention of technical limitations);
  • use the service for fraudulent or unlawful purposes.

6. Content published by users

You remain responsible for the content you publish (ratings, comments, reactions). By publishing it, you grant RakoonTV the right to display it as part of the service. We may moderate, hide or remove any content that breaches these Terms, in particular following a report.

7. Intellectual property

The brand, logo and elements of the service are the property of TENSAI IT. The metadata and visuals of works belong to TheTVDB and their respective rights holders and are used in accordance with their terms. No transfer of rights is granted to you beyond normal use of the service.

8. Personal data

The processing of your personal data is described in our privacy policy.

9. Availability and warranties

The service is provided « as is », without warranty of continuous availability or of the absence of errors. We strive to ensure reliable operation, but we may suspend or discontinue all or part of the service, in particular for maintenance or technical reasons.

10. Liability

To the extent permitted by law, TENSAI IT cannot be held liable for indirect damages resulting from the use or the inability to use the service, nor for the accuracy of metadata provided by third parties.

11. Termination

You may stop using the service and request the deletion of your account at any time. We may suspend or close an account in the event of a breach of these Terms, in particular in the event of abuse or unlawful content.

12. Changes to the Terms

These Terms may be amended. The applicable version is the one in force at the time of your use of the service. The update date appears at the top of the page.

13. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have jurisdiction, in accordance with the applicable rules. In accordance with the regulations, you may refer the matter to a consumer mediator.
